After a denial in an immigration court hearing, you are entitled to an appeal of the judge’s decision. However, this is subject to a 30 day time limit for filing the appeal. The Board of Immigration Appeals (BIA) reviews the Immigration Judge’s decision and record of proceedings commenced in Immigration Court.
The Appealing immigrant, in most cases, can only file legal briefs in support of their case. If a decision is made in immigration court, it is stayed until the appeal is pending.
